Buyers of real estate that do not save energy can claim compensation

"Guangdong Province Civil Building Energy Saving Regulations" will be implemented on July 1


   The reporter learned yesterday that Guangdong’s first provincial-level local regulations on building energy efficiency, the “Regulations on Civil Building Energy Efficiency of Guangdong Province” (hereinafter referred to as the “Regulations”) will be officially implemented on July 1. The "Regulations" clarify that developers must disclose the energy-saving information of buildings when they sell buildings. If the building does not meet the energy design indicators, buyers can request repairs or even claim losses.


   Developers are fined if they violate the "Regulations"


   If it is an energy-saving and environmentally friendly house, the owner will save a lot of living costs. But how do you know if the real estate you want to buy is energy-efficient? After July 1, real estate developers must disclose the energy consumption design indicators of the real estate, so that the public can understand clearly before buying a building. The Regulations specify that real estate development enterprises shall publish basic information such as energy consumption design indicators, energy-saving measures and protection requirements, energy-saving factory quality warranty period and other basic information of the houses sold on the sales site, in the commercial house purchase contract, residential quality guarantee letter and residential manual State, and responsible for its authenticity and accuracy. If there is a violation, the developer will be ordered by the competent authority to make corrections within a time limit; if the correction is not made within the time limit, a fine of 1%-2% of the total sales of the delivered house will be imposed; if the situation is serious, the qualification certificate will be lowered or revoked by the authority issuing the qualification certificate Certifications.


   On the other hand, buyers of commercial houses can entrust a civil building energy efficiency evaluation agency to evaluate the energy consumption design indicators specified in the purchased commercial houses during the energy-saving project quality warranty period. If the energy consumption design index is not met, the real estate development enterprise shall repair it, and bear the cost of evaluation and repair. The loss caused to the buyer shall be compensated according to law. In other words, if the owner believes that the energy saving of the house is not up to standard, it can be monitored. If the house is really not up to standard, you can ask the developer to bear the cost of evaluation and repair, and you can also ask for compensation.


   Provincial Department of Housing and Urban-Rural Development stated that the inclusion of building energy-saving measures and indicators in the "Residential Quality Assurance" will have a legal binding effect on real estate developers, allowing buyers and the public to monitor the implementation of energy-saving measures and enhance operability. It is understood that buyers of commercial houses evaluate the energy consumption design indicators specified in the commercial houses they purchase, mainly energy-saving indicators for walls, roofs, doors and windows, and sunshades.


  The new building must be equipped with solar water heating system


  Most areas of Guangdong are hot in summer and warm in winter. The focus of energy saving is on cooling in summer. Therefore, the Regulations are formulated in accordance with Guangdong's own economic development, climate characteristics, and technical routes for building energy saving.


   It is worth mentioning that the "Regulations" made the use of solar water heating systems mandatory for the first time. The "Regulations" clarify that for buildings with solar energy application conditions, the construction unit should select a suitable solar energy application system for hot water supply, etc.; the design unit should design in accordance with the relevant solar energy application standards. Construction drawing design document review and completion acceptance filing. In other words, as long as new buildings have the conditions for solar energy applications, they must install solar water heating systems.


   It is understood that this is a stricter requirement put forward by Guangdong than the national regulations, mainly considering that the current solar water heating products and application technology are relatively mature, economically feasible, and have the conditions for promotion.


   More than 90% of old buildings do not meet energy-saving standards


   It is understood that building energy efficiency in Guangdong started late, and according to the current building energy efficiency standards, more than 90% of the old buildings in the province cannot meet the requirements. The "Regulations" stipulate that the energy-saving renovation of old buildings should focus on office buildings of state agencies, large public buildings, government investment, and government-invested public buildings that do not meet energy-saving standards, and implement a combination of mandatory renovation and market guidance.


   For new public buildings (including reconstruction and expansion) with a construction area of more than 10,000 square meters, it is required to design and construct air-conditioning waste heat recovery and utilization devices. Those without supporting facilities shall not pass the review of construction drawings and design documents and the record of completion acceptance.
